Terms & Conditions
If our products don’t meet the performance standards indicated on our site or our datasheets, we will replace them at no charge.

By Purchasing any of the products from NKMAX Co. Ltd. (Hereinafter: "NKMAX"), the following terms and conditions shall apply to NKMAX branded products and services and to products distributed by NKMAX on behalf of other suppliers.

NKMAX shall be entitled to amend the terms and conditions at any time in its complete discretion by posting them on this website. Such amendments shall take effect immediately from the time of posting. Your continued use of the website after the date amendments were made shall be construed as your acceptance to such amendments.

Placing orders and prices
All orders are subject to availability. Prices of products do not include freight and packing, VAT, import duties, or other taxes where these are applicable. Price and other information provided are subject to change without notice, and prices may be changed up to the time of delivery. While every effort is made to keep information provided by NKMAX up to date, NKMAX will not be liable to you or anyone else if errors should occur in information provided on this website.

When your order is received NKMAX will confirm receipt and provide shipment date. However, formal acceptance of the order will only take place when the goods are dispatched. If prices should be changed between the time of receipt of an order and dispatch, NKMAX will contact its customer in advance.

Invoices should be paid no later than 30 days after the invoice date, and customers must themselves pay any bank charges that are incurred in making the payment. Full payment instructions are set out on the invoice.

Shipping
NKMAX reserves the right to select the packaging and shipping method for the order, which will ensure the stability of the product as well as efficient tracing. Any damage during shipment is covered by the warranty provided herein. Title of the goods and their risk of loss pass when the goods are placed with the shipper.

Packaging and products should be inspected immediately upon receipt. Notification of damage, shortages or defects should be given immediately by e-mail or fax.

Return & replacement policy
Quality is important to NKMAX. Therefore if a product does not perform as described on the datasheet please notify us within 120 days of delivery.

Our scientific experts will examine details of your protocol to determine whether the problem is protocol related or product related:
- For protocol-related problems, our experts will give you independent professional advice.
- For product-related problems, a replacement or refund will be offered.

If you do not provide details of your protocol or follow the recommendations of our experts, NKMAX will unfortunately be unable to issue a replacement or refund.

This offer is only valid for products purchased directly from NKMAX and its authorized distributors.

If items are ordered incorrectly by the customer NKMAX will consider taking them back however at its discretion. It will be subject to a 20% restocking charge on the items plus any shipping, handling and packaging costs.

In the unlikely event of receiving an incorrect item, please store as indicated on the datasheet and contact NKMAX as soon as possible. We will make arrangements for exchanging the product expediently. All requests for returns must have prior authorization. Items must be returned in the same or equivalent packaging (i.e. cold and insulated) as originally dispatched by NKMAX.

NKMAX’s products are sold for laboratory research use only, for the exclusive use of the purchaser and therefore may not be resold. NKMAX will not be liable for any professional advice it may offer in relation to the use of the products nor any claims or applications not listed in the literature or the misuse of products which include using the products for diagnostic, therapeutic or in vivo use in human subjects. NKMAX cannot provide a guarantee for all applications for which a specific reagent may be used. Should any product fail to perform as warranted or for any other claims arising from or related to the purchase of NKMAX's products, NKMAX's liability and the purchaser's remedy are strictly limited to the purchase price or replacement, at NKMAX's sole discretion, of the product. The above referred remedy shall be the sole and exclusive remedy to the exclusion of any and all other remedies including, without limitation, claims for indirect or consequential damages.

The purchaser agrees to indemnify, defend and hold NKMAX, its directors, officers, shareholders, employees, representatives and assignees (collectively, "Affiliates") harmless from and against any and all costs, liabilities, losses, and expenses resulting from any claim, suit action, or proceeding brought by any third party against NKMAX or its Affiliates alleging or arising from or related to any breach of these Terms & Conditions by the purchaser.

These Terms and Conditions reflect the entire understanding and agreement between NKMAX and the purchaser with respect to the purchase of the product(s).

Law and Jurisdiction
These Terms and Conditions will be governed by the South Korean law. The competent courts in South-Korea, will have exclusive jurisdiction on any dispute regarding the interpretation of these Terms and Conditions or other claims regarding the order.
